An Act relative to the town of Northborough and the sale of all-alcoholic beverages.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 377 of the acts of 2006 is hereby amended by striking out subsections (a) to (c), inclusive, and inserting in place thereof the following subsections:-

(a) Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the town of Northborough may grant up to 5 additional licenses for the sale of all alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138. The licenses shall be subject to all of said chapter 138 except said section 17.

(b) The licensing authority shall not approve the transfer of any license issued pursuant to this act to any location other than Northborough Crossing, which includes the property at 370 Southwest Cutoff, off Shops Way, as shown on assessors’  map 108 parcel 2, but it may grant a license to a new applicant at the same location if the applicant files with the licensing authority a letter from the department of revenue and a letter from the department of unemployment assistance indicating that the license is in good standing with those departments and that all applicable taxes have been paid.

(c) The licenses issued pursuant to this act shall be restricted to:

(1) property to be used for a commercial center at the property shown on assessors’ map 108 parcel 3, assessors’ map 109 parcel 15, assessors’ map 107 parcel 1, assessors’ map 106 parcels 3, 5, 6 or 7, or assessors’ map 98 parcel 2; and

(2) the premises currently identified as 370 Southwest Cutoff, off Shops Way, which is shown on assessors’ map 108 parcel 2, containing 7.44 acres, and is part of the development known as Northborough Crossing on Route 20 near Route 9, to promote economic vitality; provided, however, that any license restricted to the premises described in this clause shall require that (i) the sale and consumption of alcoholic beverages shall be incidental to the serving of meals  and (ii) the licensee comply with such other requirements and conditions as the licensing authority shall deem appropriate.

SECTION 2. This act shall take effect upon its passage.
