An Act relative to the trafficking of Fentanyl.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 32E of chapter 94C of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after subsection (c) the following subsection:-

(d) Any person who trafficks in fentanyl, or any derivative thereof, by knowingly or intentionally manufacturing, distributing, dispensing, or possessing with intent to manufacture, distribute, dispense, or by bringing into the commonwealth a net weight of more than 10 grams of fentanyl or any derivative thereof or any mixture containing more than 10 grams of fentanyl or any derivate thereof shall be punished by a term of imprisonment in state prison for not more than 20 years.

SECTION 2.  Said section 32E of said chapter 94C is hereby further amended by striking out in line 120, the figure ‘(d)’ and inserting in place thereof the following figure:- (e).
