An Act authorizing the Division of Capital Asset Management and Maintenance to convey a certain parcel of land in the town of Foxborough to the Foxborough housing authority.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to transfer forthwith a certain parcel of land in the town of Foxborough for affordable housing, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of chapter 200 of the acts of 2012 is hereby amended in its entirety to read as follows:-
Notwithstanding sections 33 to 38, inclusive, of chapter 7C of the General Laws or any general or special law to the contrary, the commissioner of capital asset management and maintenance may convey a certain parcel of state-owned land in the town of Foxborough to the Foxborough Housing Authority for nominal consideration for use for affordable housing purposes. The parcel contains approximately 16.02 acres and is located at the intersection of route 140 and Walnut street, adjacent to the southbound ramp of interstate highway route 95 and is shown as lot 3604 on assessors map 133 of the town of Foxborough. This parcel shall be conveyed by deed without warranties or representations by the commonwealth.
SECTION 2. Sections 2 and 3 of said chapter 200 are hereby deleted in their entirety.
SECTION 3. Said chapter 200 is hereby amended by inserting the following section:-
The use of the parcel shall be restricted to the development of affordable housing as approved by the department of housing and community development. Notwithstanding the foregoing or any general or special law to the contrary, the Foxborough Housing Authority is authorized to lease the parcel or portions thereof to one or more entities and to enter into agreements with one or more entities for the purpose of developing, constructing, operating and maintaining affordable housing on the parcel.
SECTION 4. Notwithstanding the provisions of section 34 of chapter 121B of the General Laws or any other general or special law to the contrary, any funds received by the authority as consideration for such lease may be retained by it for use in accordance with said chapter 121B and applicable regulations thereunder.
