SECTION 1. By Order of Taking dated September 9, 2013 and recorded with the Barnstable County Registry of Deeds in Book 27729, Page 199, the Town of Provincetown took the property at 26 Alden Street, Provincetown, in fee simple, by eminent domain (the “Taking”). Said property is more specifically described in said Taking as “Parcel A Area = 5,124 ± square feet and Parcel B Area = 26,283 square feet” on a Plan recorded with said Deeds in Plan Book 650, Page 94 (the “Premises”). The named owner of the Premises was the Town of Provincetown and said Premises were taken “for general municipal purposes, including the purpose of confirming the Town’s title thereto.”
By enactment of this Act, the Legislature hereby ratifies and confirms the validity of said Taking, further that it was, in fact, for a valid public purpose and that pursuant to said Taking title to the Premises was properly vested in the Town of Provincetown and is now properly vested in all those claiming by through or under the Town of Provincetown.
Upon passage, this Act shall take effect “nunc pro tunc” upon October 1, 2013, the date of recording of the Taking in the Barnstable County Registry of Deeds.
