To the Honorable Senate and House of Representatives,

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled, “An Act Validating a Special Election in the Town of Westport.”

The Westport Board of Selectmen requested that I file this special legislation on behalf of the Town of Westport. 

The Town discovered that it had not met certain statutory requirements regarding the posting of the warrant for the special election held on August 2, 2016.  This legislation would validate the acts and votes taken at the meeting and all subsequent actions made as a result of those outcomes.

I urge your early and favorable consideration of this bill.

Message from His Excellency the Governor recommending legislation relative to validating a special election in the town of Westport.

In the One Hundred and Eighty-Ninth General Court

An Act validating the actions taken at a special town election held in the town of Westport.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.    Notwithstanding section 10 of chapter 39 of the General Laws or any other general or special law or town by-law to the contrary, all acts, proceedings and votes taken by the town of Westport at its special town meeting on August 2, 2016, and all actions taken pursuant thereto, are hereby ratified, validated and confirmed to the same extent as if the election warrant had been executed and posted by the town in accordance with law.

SECTION 2.   This act shall take effect upon its passage.
