To the Honorable Senate and House of Representatives,

 

I am filing for your prompt consideration a bill entitled, “An Act Establishing a Sick Leave Bank for Timothy McCarthy, an Employee of the Division of Capital Asset Management and Maintenance.”

Mr. McCarthy is a Master Electrician working for the Division of Capital Asset Management and Maintenance.  Sick leave banks are established to provide much needed relief to state employees who have exhausted, or will soon exhaust, all leave due to serious medical challenges.  We have learned that Mr. McCarthy is in need of such relief.  This bill will enable his co-workers to donate their own vacation, sick and/or personal time on his behalf.

An Act establishing a sick leave bank for Timothy McCarthy, an employee of the Division of Capital Asset Management and Maintenance.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith a sick leave bank for a certain employee of the division of capital asset management and maintenance, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, the division of capital asset management and maintenance shall establish a sick leave bank for Timothy McCarthy, an employee of the division. Any employee of the division may voluntarily contribute 1 or more sick, personal or vacation days to the sick leave bank for use by Timothy McCarthy. If Timothy McCarthy terminates employment with the division or requests to dissolve the sick leave bank, any remaining time in the sick leave bank shall be transferred to the extended illness leave bank. Sick leave bank days shall not be used for absences unrelated to the illness or disability that necessitated the establishment of the sick leave bank as determined by the division.
