To the Honorable Senate and House of Representatives,

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled, “An Act Relative to Permitting the Town of Hull to Hold a Special Election on November 8, 2016.” 

The Hull Board of Selectmen requested that I file this special legislation on behalf of the Town of Hull. 

On May 3, 2016 at its Annual Town Meeting, the Town of Hull voted to accept the Community Preservation Act (“CPA”).  Full adoption of this law involves the second step of placing the question, along with a fair and concise summary and purpose of the law, on the ballot of the next regular municipal or state election.  The Town discovered that it had not made a required submission to the Office of the Secretary of the Commonwealth in time for the question to be placed on the state election’s ballot.   This legislation would permit the question relating to the CPA to be presented to the voters of Hull at a special local election.

An Act relative to permitting the town of Hull to hold a special election on November 8, 2016.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.    (a) Notwithstanding any general or special law or town charter by-law to the contrary, the town of Hull, by majority vote of the board of selectmen, may call for and conduct a special town election on November 8, 2016 to coincide with the date of the state and national election, for the purpose of determining if the town will accept the provisions of sections 3 to 7 of chapter 44B of the General Laws as otherwise provided for under said law.  Any such vote to call for said election prior to the effective date of this act shall be deemed effective as if this act was in effect at the time of said vote.

(b) at any such election, the town clerk shall include on the ballot the form of question and summary provided for under said law.

SECTION 2.   This act shall take effect upon its passage.
