An Act relative to student data privacy.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 71 of the Massachusetts General Laws is hereby amended by adding at the end thereof the following section:--
Section 95. For the purposes of this section the term “educational institution” shall mean a primary or secondary school, a school district or a board of cooperative educational services. Any person: (1) who provides account-based access to a website or an online service for an educational institution; (2) who marketed and designed the online service for the educational institution; and (3) who has knowledge that the online service collects data related to a student, shall not use the online service to sell student data or to process student data in furtherance of advertising; provided that the online service provider may process student data to provide, improve, develop or maintain the integrity of its online services.
