By Representative O'Day of West Boylston and Senator Chandler, a joint petition (accompanied by bill, House, No. 4761) of James J. O'Day and Harriette L. Chandler (by vote of the town) that the town of West Boylston be authorized to appoint the town clerk of said town.  Municipalities and Regional Government.  [Local Approval Received.]

An Act establishing an appointed town clerk in the town of West Boylston.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1. Notwithstanding section 1B of chapter 41 of  the general laws, or of any other general or special law to the contrary, there  shall be an appointed town  clerk in the town of West Boylston with all the powers and duties vested by law in said office.  The town clerk  shall be  appointed and  may be  removed  by the  West  Boylston  town  administrator pursuant  to this act and chapter 23 of the Acts of 1995, and any vacancy in such office shall be filled in like manner.

Section 2.  Subsection (d) of section 2 of Chapter 23 of the Acts of 1995, is hereby amended by striking out the words “(d) town clerk”.

Section 3.  Section 6 of said chapter 23 is further amended by inserting after the words “board of health,” the following words:- “, town clerk,”.

Section 4.  As of  the  effective  date  of  this  act, the  elected  office  of town  clerk  shall be abolished; provided, however, that  the incumbent town  clerk as of the effective  date shall hold said office and perform  the duties thereof  until the appointment to said office under this act is made by the town administrator.

Section 5.  This act shall take effect upon its passage.
