The Commonwealth of Massachusetts

_______________

In the One Hundred and Eighty-Ninth General Court
(2015-2016)

_______________

An Act relative to retroactive capital reimbursement for a certain nursing facility.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide retroactive reimbursement to a certain nursing facility , therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Notwithstanding any general or special law, rule or regulation to the contrary, for the nursing home licensed in accordance with Section 71 of Chapter 111 of the General Laws and which is located within the Town of Holden, and which provides services to high acuity individuals, individuals in need of ventilator treatment, and individuals in need of skilled nursing care, shall receive its requested revised capital payment filed in 2014, retroactive to July 22, 2013, inclusive. The executive office of health and human services, the office of medicaid and the Center for Health Information and Analysis and any other agency of the commonwealth having jurisdiction, shall approve an effective date of July 22, 2013 for the requested revised capital payment.
