To the Honorable Senate and House of Representatives,

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating the Actions Taken at the Annual Town and Special Elections Held in the Town of Westborough.”

The Westborough Board of Selectmen has requested that I file this special legislation on behalf of the Town of Westborough.  The purpose of the legislation is to validate the actions taken at the annual town and special state elections that will be held on March 3, 2015 and March 31, 2015.

The Town of Westborough intends to use at the elections new voting equipment that it purchased last fall.  The Town recently realized that it did not meet certain statutory requirements for changing its voting machines, including giving timely notice of that change to the Secretary of State.  This legislation would validate the elections’ votes and all actions taken pursuant to those votes.

An Act validating the actions taken at the annual town and special state elections held in the town of Westborough.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding section 34 of chapter 54 of the general laws or any other general or special law or town by-law to the contrary, the votes taken by the town of Westborough at its March 3, 2015 annual town election and special state primary election, and at the March 31, 2015 special state election, and all actions taken pursuant thereto, are hereby ratified, validated and confirmed to the same extent as if the town had complied with the statutory requirements for changing the voting machines for use at the elections.

SECTION 2.   This act shall take effect upon its passage.
