An Act relative to the siting of facilities dealing with refuse.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any section of the General Laws or any other general or special law to the contrary, the Department of Environmental Protection shall not permit, license, site or otherwise allow for the operation of any recycle/reclamation/disposal or trash transfer facility within a ten mile radius of an existing licensed/sited/operating facility.
SECTION 2. In consideration of the issuance of any permit, license, sitting or operational permissions the Department of Environmental Protection shall review the regional needs for such facility along with the related impacts upon the host community and all abutting communities within ten miles of the host community boundaries.
SECTION 3. All facilities which currently require no licensing or permitting by the Department of Environmental Protection as referred to in Section 1 of this law shall also be considered within the ten mile requirement.
