An Act to Contain Health Care Costs by Reducing Fraudulent Billing Practices.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 2 of chapter 175H of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by striking, in line 24, the word “seven” and inserting in place thereof the following:- “6”.

SECTION 2. Section 3 of chapter 175 of the General Laws, as so appearing, is hereby amended by striking, in line 15, the word “seven” and inserting in place thereof the following:- “6”.

SECTION 3. Section 6 of chapter 175 of the General Laws, as so appearing, is hereby amended by striking the first paragraph and inserting in place thereof the following:- “A person who receives a health care benefit or payment from a health care corporation or health insurer which such person knows that he or she is not entitled to receive or be paid, or a person who violates section two or section three shall be liable to the health care corporation or health insurer for  3 times the full amount of the benefit or payment, and for reasonable attorneys fees and costs, inclusive of investigation.”.

SECTION 4. Section 7 of chapter 175 of the General Laws, as so appearing, is hereby amended by striking in line 4, the words “the full amount” and inserting in place thereof the following:- “3 times the full amount”.
