An Act requiring review for determining category 4 eligibility.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 5 of chapter 32 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the word “payments”, in line 231, the following words:- ; provided, however, that notwithstanding the provisions of this subsection, said commission shall review a superannuation application for any applicant who is a member of Group 4, or has held a Group 4 position and whose last regular compensation derived from employment as a secretary of an executive office as defined in section 2 of chapter 6A and in its discretion may deny superannuation at Group 4 for the period of employment of such secretary notwithstanding section 10 or any other section of this chapter to the contrary.
