(2015-2016)

_______________

An Act authorizing the Norfolk county retirement system to grant creditable service to Susan Anderson.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to have Norfolk County Retirement System credit 3 years of service to Susan Anderson for her prior work in the State of California and Illinois, and to provide immediate opportunity for Susan Anderson to be entitled to receive all annual cost of living adjustments from the Norfolk County Retirement System granted under section 102 of Chapter 32., therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public health.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, and in order to promote the public good, the Norfolk county retirement system shall credit Susan Anderson, an educational aide in the Foxboro public school system for 7 years, with 3 years of creditable service for her service as a teacher in the state of California and the state of Illinois, for the purpose of determining her retirement allowance pursuant to chapter 32 of the General Laws; provided, however, that the Norfolk county retirement system shall require proof of such service in the states of California and Illinois; and provided further, that Susan Anderson shall satisfy all other applicable requirements for a retirement allowance pursuant to said chapter 32.  Prior to the date of any retirement allowance becoming effective, Susan Anderson shall pay, in 1 lump sum or in installments upon such terms as the Norfolk county retirement system may provide, an amount equal to the contributions Susan Anderson would have otherwise paid into the Norfolk county retirement system had she been a member during the 3 years of service, at the contribution rate applicable during such period of service, plus actuarial-assumed interest.  Susan Anderson shall be entitled and shall receive all annual cost of living adjustments granted under section 102 of said chapter 32.

SECTION 2. This act shall take effect upon its passage.
