SECTION 1. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance may, in consultation with the department of mental health, convey to Gandara Mental Health Center, Inc., for no or nominal consideration, certain parcels of land for the purpose of maintaining and operating a mental health treatment center. The parcels of land authorized to be conveyed, containing approximately 23,995 total square feet, are described as parcels “A”, “B” and “C” by taking in an instrument recorded with the Hamden county registry of deeds in book 4382, page 314, and shown on a plan entitled “Land in Springfield, Massachusetts owned by the Commonwealth of Massachusetts, North End Satellite” dated October 22, 1976, prepared by Reney Brothers, Inc. and recorded with the Hamden county registry of deeds in book 167, page 123.
SECTION 2. Notwithstanding any general or special law to the contrary, Gandara Mental Health Center, Inc. shall be responsible for all costs and expenses of the conveyance authorized in section 1 as determined by the commissioner of capital asset management and maintenance, including, without limitation, the costs of any surveys and recordings.
SECTION 3. The parcels described in section 1 shall be used for the purpose of operating a mental health treatment center. If at any time the property ceases to be used for such purposes, the commissioner of capital asset management and maintenance shall give written notice to the Gandara Mental Health Center, Inc of the unauthorized use. The Gandara Mental Health Center, Inc shall, upon receipt of the notice, have 30 days to respond and a reasonable time to establish an authorized use of the parcels. If an authorized use of the parcels is not thereafter established, the title to the parcels, upon the recording of a notice thereof by the commissioner in the appropriate registry of deeds, shall revert to the commonwealth.
