An Act extending the statute of limitations for victims of the Boston Marathon Bombing.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 260 of the General Laws is hereby amended by inserting after section 2E the following section:-
Section 2F.
(a) Any action brought by or on behalf of any victim of the Boston Marathon Bombing on April 15, 2013 to recover any costs associated with any actions of tort, actions of contract to recover for personal injuries including post traumatic stress disorder, or actions of replevin, as described in section 2A of chapter 260, shall be commenced within seven years of the Boston Marathon Bombing.
(b) A “victim” shall be taken to mean any spectator, volunteer, or other person within the “Boston Marathon Bombing Disaster Area” during the time of the bombings whose only bar to bringing such an action is the statute of limitations.
(c) Only victims with claims caused during the time of the bombings that have not yet been litigated shall be included under this Act. This act shall not supercede other bars to bringing such actions beyond the statute of limitations.
(d) The “Boston Marathon Disaster Area” shall be taken to mean the cities of Boston, Cambridge, and Watertown.
(e) The scope of this event shall cover from the moment the bombs exploded at 2:49 pm on April 15, 2013 until 8:41 pm on April 19, 2013 when the manhunt ended with the arrest of the second terrorist.
