An Act to criminalize the attempted production of Class B drugs.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 32A of Chapter 94C of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting at the end of the first paragraph the following: “; provided, that possession with intent to manufacture shall include possession of the constituent ingredients; provided further, that simple possession of the constituent ingredients shall constitute neither proof nor presumption of intent to manufacture.”
