An Act relative to respiratory therapy.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 23V of Chapter 112 of the General Laws is hereby amended by adding the following at the end thereof:-
“(e) Any employee working for a Massachusetts durable medical equipment company and having a minimum of 500 hours of positive airway pressure equipment and supply related training under the supervision of a Massachusetts licensed Respiratory Therapist may perform the delivery, set-up and maintenance of positive airway pressure equipment and supplies for home care patients with a diagnosis of obstructive sleep apnea. This exemption does not apply to clinical assessment, clinical evaluation, or clinical intervention on home care patients.”
