SECTION 1. Section 87AA of Chapter 112 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting at the end thereof the following paragraphs:-
A manicure shop and a shop where a registered manicurist provides manicure services shall post, in large letters and in a prominent place visible to customers, a warning sign that reads as follows: CHEMICALS CONTAINED IN NAIL POLISH MAY POSE HEALTH RISKS. PREGNANT WOMEN AND YOUNG CHILDREN SHOULD AVOID EXCESSIVE EXPOSURE TO THESE CHEMICALS.
In the event there is no warning sign posted on the shop’s premises, it shall be the responsibility of the Board of Registration of Cosmetologists to furnish the shop with a warning sign. The shop shall have 30 days from receipt of the warning sign to post it on the licensed premises. A shop is subject to a written warning for the first violation. For a second or subsequent violation, the shop shall pay a fine of at least twenty-five dollars but not more than one hundred dollars for each such violation. For the third and subsequent violations, each day the activity continues shall be a separate violation.
