An Act relative to the sale of wine.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Notwithstanding the provisions of Section 12 and 23 of Chapter 138 of the General Laws or any municipal rule or ordinance, any patron of a licensed restaurant, club or hotel may bring wine to be consumed on premises with a meal purchased from the restaurant, club or hotel, unless the restaurant, club or hotel objects (which it may do in its sole discretion). The restaurant, club or hotel may charge a reasonable corkage fee per bottle of wine consumed pursuant to this provision, with the amount and administration of such corkage fee to be determined by the Massachusetts Alcoholic Beverages Control Commission.
