An Act relative to Medicare Part B refunds.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 10B of chapter 32A of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the third sentence thereof the following sentence: - In the event that the Employer receives federal subsidies from the retiree drug subsidy program under the Medicare Prescription Drug, Improvement and Modernization Act of 2003 (P.L. 108-173) and such subsidies are not factored into the premium for the insurance provided herein, such subsidies shall be used to pay any premium, or portion thereof, which may be required by the federal health insurance for the aged act to be paid by enrollees thereof, up to the amount of such subsidies.
SECTION 2. Section 10C of said chapter 32A, as so appearing, is hereby amended by inserting after the third sentence thereof the following sentence: - In the event that the Employer receives federal subsidies from the retiree drug subsidy program under the Medicare Prescription Drug, Improvement and Modernization Act of 2003 (P.L. 108-173) and such subsidies are not factored ino the premium for the insurance provided herein, such subsidies shall be used to pay any premium, or portion thereof, which may be required by the federal health insurance for the aged act to be paid by enrollees thereof, up to the amount of such subsidies.
SECTION 3. Section 18 of said chapter 32A, as so appearing, is hereby amended by inserting at the end thereof, the following sentence: -In the event that the Employer receives federal subsidies from the retiree drug subsidy program under the Medicare Prescription Drug, Improvement and Modernization Act of 2003 (P.L. 108-173) and such subsidies are not factored into the premium for the insurance provided herein, such subsidies shall be used to pay any premium, or portion thereof, which may be required by the federal health insurance for the aged act to be paid by enrollees thereof, up to the amount of such subsidies.
SECTION 4. Section 18A of Chapter 32B of the General Laws, as amended by chapter 68 of the acts of 2011, is hereby amended by inserting at the end thereof the following subsection: -
(d) In the event that the Employer receives federal subsidies from the retiree drug subsidy program under the Medicare Prescription Drug, Improvement and Modernization Act of 2003 (P.L. 108-173) and such subsidies are not factored into the premium for the insurance provided herein, such subsidies shall be used to pay any premium, or portion thereof, which may be required by the federal health insurance for the aged act to be paid by enrollees thereof, up to the amount of such subsidies.
