SECTION 1. Section 5 of chapter 141 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by striking the first sentence and inserting in place thereof, the following:-
“Any person entering upon or engaging in the business and work as defined in this chapter, without having complied with this chapter, shall for the first instance of non-compliance, be punished by a fine of not less than $2,500 and not more than $5,000, and for a second instance of non-compliance by a fine of not less than $3,500 and not more than $7,500, and for each instance of non-compliance thereafter, a fine of not less than $5,000 and not more than $10,000.
Any corporation whose employees, contractors or subcontracts entering upon or engaging in the business and work as defined in this chapter, without having complied with this chapter, shall for the first instance of non-compliance be punished by a fine of not less than $2,500 and not more than $5,000, and for a second instance of non-compliance by a fine of not less than $3,500 and not more than $7,500, and for each instance of non-compliance thereafter, be punished by a fine of not less than $5,000 and not more than $10,000 and a suspension of all electrical licenses of those involved in the electrical work in which the violation occurred for one year.
For the purpose of this section, “instance” shall mean an individual occurrence of work performed by a person or by a person performing work as an employee, contractor, or subcontractor of a corporation.”
