An Act relative to the retirement benefits of certain widows and surviving spouses.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding the provisions of section 498 of chapter 159 of the acts of 2000, the provisions of sections 9 and 100 of chapter 32 of the General Laws shall apply to the surviving spouse of a member, who remarried prior to July 1, 2000 and whose pension, upon remarriage, was terminated or otherwise reduced subject to the provisions of sections 9 and 100 of said chapter 32.

SECTION 2.  Notwithstanding the provisions of section 498 of chapter 159 of the acts of 2000, the provisions of paragraph (d) of subdivision (2) of section 12 of chapter 32 of the General Laws shall apply to the spouse of a deceased member, who remarried prior to July 1, 2000 and whose pension, upon remarriage, was terminated or otherwise reduced subject to the provisions of paragraph (d) of subdivision (2) of section 12 of said chapter 32.

SECTION 3.  Notwithstanding the provisions of section 498 of chapter 159 of the acts of 2000, the provisions of section 101 of chapter 32 of the General Laws shall apply to the widow of a member, who remarried prior to July 1, 2000 and whose pension, upon remarriage, was terminated or otherwise reduced subject to the provisions of section 101 of said chapter 32.

SECTION 4.  The provisions of this act shall be prospective from the effective date of this act and shall not entitle any surviving spouse, spouse of a deceased member or widow to any retroactive benefits.
