An Act promoting the use of total energy impact analysis.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 44M of chapter 149 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the definition of “energy system” the following definition:-

“Life-cycle energy analysis,” a simple comprehensive analysis, in understandable units, based on existing measurements of the total energy implications and consumption of resources across all domains, including water, electricity, transportation, gas waste and materials.

SECTION 2. Said section 44M of said chapter 149 is hereby further amended by inserting in line 20 after the words “life-cycle cost estimates” the following words:-

SECTION 5. Said section 44M of said chapter 149 is hereby further amended by inserting in line 31 after the words “cost estimates” the following words:-

and life-cycle energy analysis

SECTION 6. Notwithstanding the provisions of any general or special law to the contrary, state agencies required to conduct a life-cycle cost analysis of the construction of a new facility, or substantial renovation of an existing facility that includes the replacement of systems, components, and other building elements which affect energy or water consumption, and which is either owned or operated by the commonwealth, under Section 331 of Chapter 164 of the Acts of 1997, shall also conduct a regular and periodic life-cycle energy analysis that analyzes, in understandable units, based on existing measurements, the total energy implications and consumptions of resources across all domains, including water, electricity, transportation, gas, waste and materials. Such state agency shall use such analyses to establish benchmarks for total energy impacts with the goal of improving sustainability.

Each such state agency shall also include in the report required under Section 331(a)(iv) of Chapter 164 of the Acts of 1997 its compliance with the provisions of this section.

The division of capital planning and operations shall establish, by no later than January 1, 2015, a methodology for use by agencies in assessing life-cycle energy consumption. The division of energy resources shall include the compliance record of all state agencies with the provisions of this section in its annual report to the general court under Section 331(c) of Chapter 164 of the Acts of 1997.
