SECTION 1. Section 1 of chapter 138 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the definition of “malt beverages,” the following:-
“powdered alcohol”, a product that is manufactured into a powdered or crystalline form that contains any amount of alcohol.
SECTION 2. Chapter 138 of the General Laws is hereby amended by inserting after section 2 the following section:-
Section 2A Except as provided in this section, no person shall use, possess, sell, offer for sale or use, manufacture with intent to sell, or expose or keep for sale, store, transport, import or export powdered alcohol. Whoever violates this section shall be punished except by a fine of not less than one hundred nor more than one thousand dollars or by imprisonment for not more than one year, or both.
This section does not apply to the use of powdered alcohol for bona fide research purposes by a health care provider that operates primarily for the purpose of conducting scientific research;
(2) state institution;
(3) private college or university; or
(4) pharmaceutical or biotechnology company.
