An Act relative to net metering.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 138 of chapter 164, as amended by section 24 of chapter 209 of the acts of 2012 is hereby further amended by inserting, after the word “digestion” the following word:- , water,

SECTION 2. Section 138 of chapter 164 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the words “solar net metering facility” in line 37 the following words:- , hydropower net metering facility,

SECTION 3. Section 138 of chapter 164 of the General Laws, as appearing, is hereby further amended by inserting after the words “solar net metering facility” in line 55 the following words:- , hydropower net metering facility,

SECTION 4. Section 138 of chapter 164, as amended by section 26 of chapter 209 of the acts of 2012 is hereby further amended by inserting after the words “, anaerobic digestion net metering” the following words:- , hydropower net metering facility,

SECTION 5. Section 138 of chapter 164 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the definition of “Customer”, the following definition:- “Hydropower net metering facility”, a facility for the production of electrical energy that uses water to generate electricity and is interconnected to a distribution company.

SECTION 6. Section 139 of chapter 164 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the word “conditions” in line 75 the following words:- , the capacity of a hydropower net metering facility shall be the nameplate rating,

SECTION 7. Subsection (f) of section 139 of chapter 164 as amended by section 29 of chapter 209 of the acts of 2012 is hereby further amended by striking the entire section and inserting in place thereof the following section:-

Section 29. Said subsection (f) of said section 139 of said chapter 164, as so appearing, is hereby further amended by inserting after the word “facility”, in line 76, the following words:- , an anaerobic digestion net metering facility, or a hydropower net metering facility.
