An Act increasing the penalty for distracted driving.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 13B of chapter 90, as appearing in the 2012 Official Edition, is hereby amended by striking out subsections (b) and (c) and inserting in place thereof the following subsections:-
(b) A violation of this section shall be punishable by a fine of $200 for a first offense, a fine of $500 for a second offense, and a fine of $500 for a third or subsequent offense and loss of license for a period of 90 days.
(c ) A third or subsequent offense under this section shall be a surchargeable offense under section 113B of chapter 175.
SECTION 2. Chapter 90, as so appearing, is hereby amended by inserting after section 24X the following section:-
Section 24Y. No individual shall use a cell phone while operating a motor vehicle within a school zone. A violation of this section shall be punishable by a fine of $100 for a first offense, a fine of $250 for a second offense, and a fine of $500 for a third or subsequent offense. These fines shall accrue in addition to fines outlined in section 13B of chapter 90.
