An Act relative to the authorization of the retirement board of the city of Westfield to grant a superannuation retirement benefit to Lynda Cavanaugh.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.(a) Notwithstanding section 12 of chapter 32 of the General Laws or any other general or special law to the contrary, the retirement board of the city of Westfield may provide Lynda Cavanaugh, the surviving fiancée of firefighter Kevin Regan, a lifetime, monthly allowance equal to the amount that an eligible surviving spouse beneficiary would receive pursuant to option (d) of subdivision (2) of said section 12 of said chapter 32 as if Kevin Regan, as the electing member, had nominated her as his sole beneficiary prior to his death. Said allowance shall be payable as of the date of Kevin Regan's death.

(b) The retirement board of the city of Westfield may, by majority vote at a public meeting, elect to provide the benefit available pursuant to this act. Upon such a majority vote, the benefit shall become payable, but not otherwise.

(c) Any retirement benefit provided to Lynda Cavanaugh pursuant to this act shall be in lieu of, and not in addition to, any benefits she may have otherwise received from the Westfield Retirement System as Kevin Regan's beneficiary.

SECTION 2. This act shall take effect upon its passage.
