An Act authorizing the town of Middleborough to exchange certain parcels of conservation land.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The board of selectmen and the conservation commission of the town of Middleborough may convey to the owner of the parcel of land described in section 2 the land on Old Center street and Erica avenue, shown as lot 388 on the town’s assessors’ map 49, containing 1.2 acres more or less, and further described in a deed of Shirley L. Holmes recorded in the Plymouth county registry of deeds in book 15773, page 280 which the town currently held for conservation purposes
SECTION 2. As consideration for the conveyance of the parcel identified in section 1, the board of selectmen and the conservation commission of the town of Middleborough may purchase a parcel of land containing 7.88 acres, more or less, located on or off Wood street and being a part of lot 2565 on the town’s assessors’ map 52 and further being shown as lot 5 on a plan of land dated December 3, 2014 entitled “Thrush Hollow” – a Residential Subdivision in Middleborough, Mass, prepared by Outback Engineering, Incorporated. The land acquired shall be under the care and control of the conservation commission to be held for conservation purposes. The purchase price for this parcel shall be $50,000 which shall be appropriated from the Budgeted Reserve Fund of the Community Preservation Fund to pay in part for such purchase.
SECTION 3. For the purpose of completing the transactions authorized in this act, the board of selectmen and the conservation commission of the town of Middleborough may file any applications for gifts, grants or other reimbursements from the commonwealth or from any other public or private entity or person. The proceeds of any gifts, grants or reimbursements received pursuant to this section shall be deposited in the Budgeted Reserve Fund of the Community Preservation Fund. The board of selectmen and the conservation commission may execute any agreements relating to the land transfers authorized in this act including, but not limited to, the granting or imposition of a perpetual conservation restriction on the parcel of land to be acquired by the town pursuant to section 2.
SECTION 4. This act shall take effect upon its passage.
