In the One Hundred and Eighty-Ninth General Court

An Act relative to charter school community impacts.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 89 of chapter 71, as appearing in the 2012 Official Edition, is hereby amended in line 100 after the word “profile;” by striking the word “and”
SECTION 2. Said section of chapter 71 is hereby further amended in line 102 by inserting after the word “schools” the following:-
“; and (xvii) an analysis of the anticipated impact on community involvement, educational opportunities and financial capacity of the district or districts from which the charter school is expected to enroll students.”
SECTION 3. Said section of chapter 71 is hereby further amended in line 272 by inserting at the end thereof the following:-
“Said criteria shall include a requirement that the applicant demonstrate that the charter school shall not diminish the fiscal capacity of the schools in the district or districts from which the charter school draws students to provide appropriate educational opportunities to students who remain in the district's non-charter public schools.”
