An Act regarding Medicaid eligibility for seniors.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 25 of chapter 118E of the General Laws is hereby amended by striking out subsection (1) in its entirety and replacing it with the following new subsection:-

(1) Monthly income in an amount not exceeding the level equivalent of 135% of the federal poverty level;

SECTION 2. Section 25 of chapter 118E of the General Laws is hereby amended by inserting after subsection (5) the following:

(6) resources in an amount determined annually in accordance with  42 U.S.C. §1395w-114(a)(3), the criteria used for a Medicare Part D low- income subsidy for individuals with income up to 150 percent of the federal poverty level.

The division shall file for any necessary waiver, amend its state plan to the extent required by law and promulgate regulations to implement said resource exemption.
