An Act relative to notice of payment of services.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 3 of Ch. 175H of the general laws, as appearing in the 2014 Official Edition, is hereby amended by inserting, at the end thereof, the following:
“An insured who receives a check or other form of payment or voucher from an insurer to pay for services rendered by a provider to the insured, is liable under this section if such insured fails to fully reimburse the service provider within 30 days of insured’s receipt of funds disbursed by insurer. Insurer shall include a statement of disclaimer to the insured with the check or other payment voucher notifying the insured, in a clear and conspicuous manner, that failure to make payment in full to service provider will result in civil and/or criminal liability pursuant to this section. Upon issuance of check or other payment voucher to an insured, the insurer shall send notification to the service provider entity indicating that payment of claim for services has been disbursed to insured.”
