An Act further regulating the Baker Hill Road District in the town of Lanesborough.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section two of chapter 41 of the acts of 1989 is hereby amended by inserting the following section after the word “way” in the first paragraph:-
“and without intending to limit its authority, to retain or recruit business, promote economic development, design, engineer, construct, maintain, or operate buildings, facilities, streetscapes or infrastructure to further economic development and public purposes, leasing, owning, acquiring, or optioning real property; supplementing maintenance, security, or sanitation, planning and design services; undertaking planning, feasibility and market analyses, developing common marketing and promotional activities, and supporting public art and human and environmental services as related to the enhancement of the district.
SECTION 2. Paragraph (a) Section two of chapter 41 of the acts of 1989 is hereby amended by inserting the following section after “to acquire, by purchase, gift, or devise the road upon substantial completion of its construction and to maintain the road as a public way of the District,” :-
“to acquire by purchase, gift, or devise real property within the District, and to purchase or lease equipment, materials and services necessary or appropriate for the purposes of the District to the same extent and subject to the same limitations as shall apply to Towns of this Commonwealth.
SECTION 3. Paragraph (e) of section two of chapter 41 of the acts of 1989 is hereby amended by deleting the line “but for none other,”.
SECTION 4. Paragraph (j) of Section two of chapter 41 of the acts of 1989 is hereby amended by deleting after the word “loan,” the line “including without limitation any grant, gift or loan from agencies of local, state or federal government, donation or appropriation of any property or money in aid of the purposes of the District and to accept any such financial aid received by the District from the Commonwealth shall not be deemed to be aid received by the town;” and replacing it with:-
“as if it were a town exercising the powers enumerated in M.G.L. c. 40 and c. 40O, including without limitation any grant, gift or loan from agencies of local, state or federal government, donation or appropriation of any property or money in aid of the purposes of a town and to accept contributions of money, property, labor or other things of value, provided, however, that any such financial aid received by the District from the commonwealth shall not be deemed to be aid received by the Town of Lanesborough;”.
SECTION 5. Section seven of chapter 41 of the acts of 1989 is hereby amended by deleting after the line “providing funds for” the line “paying the cost of acquisition of land and maintenance of the road as described in the act and the costs of issuance of such bonds.” in the first sentence and replacing it with the line:-
“carrying out the purposes of the act and the costs of issuance of such bonds.”
SECTION 6. This act shall take effect upon passage.
