By Representative Linsky of Natick and Senator Ross, a joint petition (accompanied by bill, House, No. 1106) of David Paul Linsky, Richard J. Ross and Shawn Dooley (by vote of the town) relative to authorizing the town of Millis to transfer certain recreation property in exchange for dedication of conservation land.  Municipalities and Regional Government.  [Local Approval Received.]

An Act authorizing the town of Millis to transfer a certain parcel of park land.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding the provisions of any general or special law to the contrary and pursuant to the provisions of article 97 of the amendments to the Constitution of the Commonwealth of Massachusetts, the town of Millis board of selectmen, acting in its capacity as the Millis board of park commissioners, is hereby authorized to transfer a parcel of land, currently held for park and other recreational uses, shown as “Parcel A,” containing 6.40 +/- acres, on a plan entitled "School Property – Plan of Land Proposed Article 97 Land Exchange Millis Massachusetts," dated January  2, 2017, prepared by Nitsch Engineering, to the care, custody, management and control of the Millis school committee, for school purposes.

SECTION 2.  In consideration for the transfer of the land as provided in section 1 of this act, the town of Millis board of selectmen shall transfer the parcel of land, shown as “Parcel B,” containing 1.84 +/- acres, currently held for general municipal purposes, and the town of Millis school committee shall transfer the parcels of land, shown as “Parcel C,” containing 1.09 +/- acres, “Parcel D,” containing 3.21 +/-acres and “Parcel E,” containing 3.74 +/- acres, currently held for school purposes, all the foregoing parcels described on a plan entitled “Article 97 Property – Plan of Land Proposed Article 97 Land Exchange Millis Massachusetts,” dated January 2, 2017, prepared by Nitsch Engineering, to the care, custody, management and control of the Millis conservation commission, for conservation and passive recreational purposes, which parcels shall be subject and dedicated to the provisions of article 97 of the amendments to the Constitution of the Commonwealth of Massachusetts.

SECTION 3.  This act shall take effect upon passage.
