An Act regarding municipal fines.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of chapter 40U of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by deleting the definition of “unpaid charge” and inserting in place thereof the following:-
“Unpaid charge,” an unpaid fine incurred as a result of a violation of a rule, code, regulation, order, ordinance or by-law regulating the housing, sanitary, building, zoning and environmental, or municipal snow and ice removal requirements.
SECTION 2. Said chapter 40U, as so appearing, is hereby amended by deleting section 8 and inserting in place thereof the following section:-
Section 8. Every officer and inspector who takes notice of a violation of a rule, code, regulation, order, ordinance or by-law regulating the housing, sanitary, building, zoning and environmental, or snow and ice removal requirements shall provide the offender with a notice forthwith, which shall be in tag form, to appear before the municipal hearing officer or the hearings officer’s designee during regular office hours, not later than 21 days after the date of such violation. All tags shall be prepared in triplicate or by the use of an automated ticketing device and shall be pre-numbered.
SECTION 3. Section 11 of said chapter 40U, as so appearing, is hereby amended by deleting that part of the second sentence after the word “housing” and inserting the following:-
, building, zoning and environmental, sanitary or municipal snow and ice removal requirements, excluding late fees.
SECTION 4. This act shall take effect upon its passage.
