An Act to establish licensing standards for drain cleaners.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, the Board of Examiners of Plumbers shall promulgate rules and regulations providing for the licensing of drain cleaners in the Commonwealth of Massachusetts.  Such rules and regulations shall establish distinct classes of drain cleaner licenses as deemed appropriate by the Board, to include but not limited to apprentice level licenses and master level licenses.

SECTION 2. Any person or entity engaging in drain cleaning without a license shall be subject to a civil administrative penalty under the provisions of section 65A of chapter 112 of the General Laws.

SECTION 3. All licensing and application fees and civil administrative penalties collected pursuant to this act shall be deposited into the Division of Professional Licensure Trust Fund established by section 35V of chapter 10 of the General Laws.
