There shall be a commission entitled the Legislative Sunset Advisory Commission, which shall conduct a review of the Massachusetts General Laws and amendments thereof. The commission shall consist of 3 members of the senate, 2 of whom shall be appointed by the senate president and 1 of whom shall be appointed by the minority leader of the senate; 3 members of the house, 2 of whom shall be appointed by the speaker of the house and 1 of whom shall be appointed by the minority leader of the house of representatives; the house clerk; senate clerk; house counsel; senate counsel; the state auditor or a designee; and 2 members appointed by the governor who shall have performance auditing experience. Commission members shall serve for a 2 year term and shall remain in office until a successor is appointed.
The Legislative Sunset Advisory Commission shall examine the language and objectives of all the General Laws and make recommendations, if any, to improve them. The Legislative Sunset Advisory Commission shall submit to the counsel to the senate and to the counsel to the house of representatives, jointly, recommendations, including drafts of legislation, for the correction, revision, amendment, rearrangement, consolidation, compilation and recodification of the General Laws, or any of them, and amendments thereof, including recommendations for the repeal of such statutory provisions as have become obsolete or the reasons for the enactment of which have ceased to exist. The Legislative Sunset Advisory Commission may recommend the omission or repeal of redundant enactments and those which may have ceased to have any effect on existing rights, the rejection or elimination of superfluous words, the condensation of circuitous, tautological and ambiguous phraseology and the correction of mistakes, inconsistencies and imperfections found in the General Laws.
The Legislative Sunset Advisory Commission shall file a report of its findings and recommendations with the senate and house clerks and with the governor biannually beginning on January 1, 2017.
