An Act relative to cool season grass seed.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 86 of chapter 128 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended in line 21 by inserting after the word “percentages”, the following:-
, and provided further that lawn seeding mixtures may also include a “sell by” statement
SECTION 2. Section 90 of chapter 128 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended in line 2 by inserting after the words “flower or tree and shrub seed” the following:-
, except for cool season lawn and turf grass seed mixtures as provided in (a),
SECTION 3. Section 90 of chapter 128 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting at the end thereof the following:-
(a)No person shall sell, offer for sale or expose for sale any cool season lawn and turf grass seed within the commonwealth unless the test to determine the percentage of germination required by section eighty-six was completed within a 15 month period, exclusive of the calendar month in which the test was completed, immediately prior to sale, exposure for sale or offering for sale or transportation.
SECTION 4. Section 84 of chapter 128 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting the following definition for “cool season lawn and turf grass seed”:-
“cool season lawn and turf grass seed", means the seed of any lawn and turf grass identified in the section of the most current Recommended Uniform State Seed Law, as established by the Association of American Seed Control Officials, pertaining to label requirements for agricultural, vegetable, and flower seeds.
