An Act regarding the authority of the Alcoholic Beverages Control Commission over the business of marijuana establishments.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to establish forthwith for the authority of the alcoholic beverages control commission over the business of marijuana establishments, , therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 10 of the General Laws is hereby amended by striking out sections 76 and 77 and inserting in place thereof the following section:-
Section 76. The alcoholic beverages control commission, pursuant to chapter 94G, shall have general supervision and sole regulatory authority over the conduct of the business of marijuana establishments as defined in said chapter 94G.
SECTION 2. Clause (c) of section 1 of chapter 94G of the General Laws is hereby amended by striking out the words “cannabis control commission established by section 76 of chapter 10 of the General Laws” and inserting in place thereof the following words:- alcoholic beverages control commission.
SECTION 3. Section 4 of said chapter 94G is hereby amended by striking out the title “The Cannabis Control Commission” and inserting in place thereof the title:- The Alcoholic Beverages Control Commission.
SECTION 4. Subsection (a) of said section 4 of said chapter 94G is hereby amended by striking out the words “in consultation with the cannabis advisory board and”.
SECTION 5. Section 6 of chapter 334 of the acts of 2016, as amended by chapter 351 of the acts of 2016, is hereby further amended by striking out the words “cannabis control commission” and inserting in place thereof the following words:- “alcoholic beverages control commission”.
SECTION 6. Sections 7 and 8 of said chapter 334, as amended by said chapter 351, are hereby repealed.
SECTION 7. Section 9 of said chapter 334, as amended by said chapter 351, is hereby further amended by striking out the words “cannabis control commission” and inserting in place thereof the following words:- alcoholic beverages control commission.
