By Representative Peake of Provincetown and Senator Cyr, a joint petition (accompanied by bill, House, No. 2424) of Sarah K. An Act authorizing the town of Truro to convey a perpetual trail easement on conservation land to Truro conservation trust.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding the provisions of any general or special law to the contrary and pursuant to the provisions of article 97 of the amendments to the constitution of the commonwealth of Massachusetts, the town of Truro, acting by and through its board of selectmen, is hereby authorized to convey to the Truro conservation trust, a Massachusetts charitable trust, a perpetual trail easement in and to a portion of a certain parcel of the town-owned conservation land identified in section 2 below, extending from route 6 in said town through said parcel to adjacent land owned by said Truro conservation trust and identified in section 3 below.

SECTION 2.  Said parcel of town-owned, to be subject to the foregoing easement, is located at 139 State Route 6, shown as lot 5 on a plan recorded with the Barnstable registry of deeds in plan book 569, page 44, and described in a deed recorded with said deeds in book 14745, page 101, and was acquired by said town for the purposes set in chapter 293 of the acts of 1998, also known as “An Act establishing the Cape Cod open space acquisition program”.

SECTION 3.  The parcel of land owned by said Truro conservation trust and benefiting from the easement set forth in section 1 is described in a deed recorded with said deeds in book 29489, page 328, and shown as lot 4 on the above-referenced plan.

SECTION 4.  This act shall take effect upon its passage.
