An Act relative to retirement credit for out of state service.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
AN ACT RELATIVE TO RETIREMENT CREDIT FOR OUT OF STATE SERVICE
SECTION1:
Subsection 4 of section 3 of chapter 32 of the General Laws as appearing in the 2014 official edition is hereby amended by adding to the end of the first paragraph thereof the following:
Provided further, however, that where a member is seeking to obtain credit for out of state service for which he is entitled to receive a retirement allowance from any other state as a result of that state’s requirement that, as a condition of employment, he participate in a defined benefit plan to which the employer makes a contribution, the member shall waive receipt of that benefit or refund that benefit to the other state and purchase such credible service by paying into the Teachers’ Retirement System an amount equal to that which would have been withheld as regular deductions from his regular compensation for such previous period or most recent portion thereof, as he may elect, had such service been rendered in a public school of the Commonwealth and had he been a member of the Teachers’ Retirement System during the period the service was rendered.
