An Act relative to the Massachusetts clean water trust.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Subsection (a)(v) of section 4 of chapter 29C, as so appearing in the 2014 Official Edition, is hereby amended by striking, in line __, the word “and” and inserting the following subsection at the end thereof:-

“(vi) amounts collected from a transaction surcharge of ten cents per thousand dollars on all real estate sales, provided that such funds shall be administered pursuant to section 6 of chapter 29C; and”

SECTION 2. Subsection (a)(vi) of section 4 of chapter 29C, as so appearing in the 2014 Official Edition, is hereby amended by striking, in line __, the number “vi” and inserting the following in place thereof:- “vii”.

SECTION 3. Chapter 36 of the general laws, as appearing in the 2014 Official Edition, is hereby amended by inserting the following new section at the end thereof:-

“Section 119. Upon the recording or registering of any sale of real property, there shall be paid to the recorder ten cents per thousand dollars on all real estate sales as a water infrastructure surcharge.  Each registrar of deeds shall forward such surcharge amounts to Massachusetts Clean Water Trust established in section 2 of chapter 29C.
