An Act authorizing the Massachusetts Department of Transportation to acquire certain parcels of land in the town of Southborough.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1. The Massachusetts Department of Transportation is, hereby, authorized to acquire by eminent domain, purchase or otherwise certain parcels of land in the Town of Southborough described in Section 2 herein-below from the Massachusetts Department of Conservation and Recreation.  The parcels are to be diverted from their present use for purposes of conservation and recreation to a highway/drainage use.

Section 2. The description of the below referenced parcels are shown on a plan for Southborough-2016 Alteration, Project File No. 607488, Layout No. 8552, by Greenman-Pedersen, Inc., 181 Ballardvale Street, Suite 202, Wilmington, Massachusetts 01887, which plan is on file with the Chief Engineer of the Highway Division of the Massachusetts Department of Transportation and which parcels are further bounded and described as follows:

PARCEL 11-6: A parcel of land supposed to be owned by Commonwealth of Massachusetts (Department of Conservation and Recreation), adjoining the southerly location line of the April 14, 1931 State highway layout  (Layout No. 2759) of Boston-Worcester Turnpike (Route 9) and bounded by the line described as follows:

Beginning at a point on the southerly location line of the April 14, 1931 State highway layout  (Layout No. 2759) of Boston-Worcester Turnpike (Route 9), said point bearing S 11°59’06” E and being 45.00 feet distant from station 132+76.89 of the baseline of location of the said 1931 layout, and extends thence, leaving said 1931 location line S 76°15’30” W 64.20 feet; thence by a curve to the right of radius 2,000.00 feet 130.84 feet; thence by another curve to the right of radius 5,637.00 feet about 106 feet to a point on the property line dividing land of Commonwealth of Massachusetts (Department of Conservation and Recreation) and land of Wells Fargo Bank, N.A.; thence following said property line northwesterly about 9 feet to a point again on the southerly location line of the April 14, 1931 State highway layout  (Layout No. 2759) of Boston-Worcester Turnpike (Route 9); thence leaving said property line and following said location line northeasterly by a curve to the left about 308 feet to the point of beginning; containing about 1,168 square feet.

PARCEL 11-8: A parcel of land supposed to be owned by Commonwealth of Massachusetts (Department of Conservation and Recreation), adjoining the southerly location line of the April 14, 1931 State highway layout (Layout No. 2759) of Boston-Worcester Turnpike (Route 9), the location line of the October 18, 1955 State highway alteration (Layout No. 4361) of Boston-Worcester Turnpike (Route 9), and bounded by the line described as follows:

Beginning at a point on the location line of the October 18, 1955 State highway alteration (Layout No. 4361) of Boston-Worcester Turnpike (Route 9), said point bearing S 14°26’07” E and being 79.37 feet distant from station 148+22.58 of the baseline of location of the said 1931 layout, and extends thence, leaving said 1955 location line N 26°17’53” W 12.56 feet; thence by a curve to the left of radius 22.00 feet 29.72 feet; thence S 76°17’23” W 125.08 feet; thence S 76°51’45” W 133.36 feet to a point on the southerly location line of the April 14, 1931 State highway layout  (Layout No. 2759) of Boston-Worcester Turnpike (Route 9); thence following said location line northeasterly about 253 feet to a point again on the location line of the October 18, 1955 State highway alteration (Layout No. 4361); thence following said 1955 location line southeasterly by a curve to the right about 52 feet to the point of beginning; containing about 761 square feet.

PARCEL 11-PUE-10:  A parcel of land supposed to be owned by Commonwealth of Massachusetts (Department of Conservation and Recreation), adjoining the northerly location line of the April 14, 1931 State highway layout  (Layout No. 2759) of Boston-Worcester Turnpike (Route 9) and bounded by the line described as follows:

Beginning at a point on the said northerly location line of the April 14, 1931 State highway layout, said point bearing N 14°26’07” W and being 45.00 feet distant from station 138+75.07 of the baseline of location of the said 1931 layout, and extends thence, leaving said location line N 13°55’15” W 15.56 feet; thence N 76°04’45” E 6.00 feet; thence S 13°55’15” E 15.51 feet to a point again on the said northerly location line of the April 14, 1931 State highway layout; thence following said location line southwesterly about 6 feet to the point of beginning; containing about 93 square feet.

PARCEL 11-PUE-11:  A parcel of land supposed to be owned by Commonwealth of Massachusetts (Department of Conservation and Recreation), adjoining the northerly location line of the April 14, 1931 State highway layout  (Layout No. 2759) of Boston-Worcester Turnpike (Route 9) and bounded by the line described as follows:

Beginning at a point on the said northerly location line of the April 14, 1931 State highway layout , said point bearing N 14°26’07” W and being 45.00 feet distant from station 139+97.77 of the baseline of location of said 1931 layout, and extends thence, leaving said location line N 13°54’13” W 11.87 feet; thence N 76°05’47” E 6.00 feet; thence S 13°54’13” E 11.82 feet to a point again on the said northerly location line of the April 14, 1931 State highway layout; thence following said location line northwesterly about 6 feet to the point of beginning; containing about 71 square feet.

PARCEL 11-PUE-12:  A parcel of land supposed to be owned by Commonwealth of Massachusetts (Department of Conservation and Recreation), adjoining the northerly location line of the October 18, 1955 State highway alteration (Layout No. 4361) of Boston-Worcester Turnpike (Route 9), the westerly location line of the 1856 Town layout of Woodland Road, and bounded by the line described as follows:

Beginning at a point on the northerly location line of the October 18, 1955 State highway alteration (Layout No. 4361) of Boston-Worcester Turnpike (Route 9) and the westerly location line of the 1856 Town layout of Woodland Road, said point bearing S 14°26’07” E and being 79.37 feet distant from station 148+22.58 of the baseline of location of the April 14, 1931 State highway layout (Layout No. 2759) of Boston-Worcester Turnpike (Route 9), and extends thence, leaving said 1955 location line and following said 1856 location line southerly about 28 feet; thence leaving said 1856 location line N 23°45’24” W 54.91 feet; thence southwesterly by a curve to the left of 22.00 feet radius 18.28 feet; thence S 26°17’53” E 12.56 feet to the point of beginning; containing about 299 square feet.

PARCEL 11-PUE-24:  A parcel of land supposed to be owned by Commonwealth of Massachusetts (Department of Conservation and recreation), adjoining the northerly location line of the April 14, 1931 State highway layout(Layout No. 2759) of Boston-Worcester Turnpike (Route 9) and bounded by the line described as follows:

Beginning at a point on the said northerly location line of the April 14, 1931 State highway layout, said point bearing N 11°37’37” W and being 45.53 feet distant from station 132+51.56 of the baseline of location of the said 1931 layout, and extends thence, leaving said location line N 79°11’29” E 38.72 feet; thence N 76°24’42” E 135.42 feet to a point again on the said northerly location line of the April 14, 1931 State highway layout; thence following said location line southwesterly by a curve to the right about 174 feet to the point of beginning; containing about 287 square feet.
