An Act establishing emergency medical services for veterans.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 111C of the General Laws is hereby amended after inserting section 25 the following section: -

Section 25A. A veteran, as defined in Massachusetts General Law Chapter 4, Section 7, clause 43, who is in need of medical assistance at the scene of their illness or injury, shall be transported to the closest appropriate health care facilities in the shortest period of time. All costs associated with the medical treatment shall be paid in full by the Veterans Administration as would be normally covered if the veteran received medical treatment at a Veterans hospital.

The medical facility, other than the Veterans Hospital, providing such medical treatment shall recover all costs associated with said treatment to the Veterans Administration.

In the event the Veterans Administration does not reimburse the medical facility who provided medical services, the medical facility can seek reimbursement from Massachusetts Mass Health Section 1115. Demonstrating Safety Net Care Pool Uncompensated Care Cost Limit protocol fund.

The Commonwealth of Massachusetts shall seek reimbursement from the Veterans Administration for all medical services provided to said veteran paid from the Demonstrating Safety Net Care Pool Uncompensated Care Cost Limit protocol fund for medical treatment provided to a veteran.
