An Act to benefit the Community Hospital Reinvestment Trust Fund.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any special or general law to the contrary, Section 2TTTT of Chapter 29 of the General Laws, as appearing in the 2014 Official Edition is hereby amended by inserting at the end of subsection (a) the following:- In order to increase annual allotments into the Community Hospital Reinvestment Trust Fund, The Secretary shall establish a new Large Physician Organizations Assessment that proportionally assesses not more than $20,000,000 in funds from independent, 501(c)(3) non-profit physician organizations with more than 500 physician members, provided, that such Large Physician Organizations shall not be controlled or owned by a licensed acute care hospital or hospital system. Such Large Physician Organization - whether a Provider Organization or a local practice group as these terms are utilized by the Center for Health Information and Analysis - shall be considered independent, however organized, so long as such practice is owned and controlled by one or more of the physicians in the organization. Each Large Physician Organization subject to this assessment shall be liable for a proportional share of the total annual assessment that is calculated relative to their annual commercially insured net patient service revenue.
Any such non-profit, large physician organization shall be exempt from this assessment if their percentage of gross charges reimbursed by the state Office of Medicaid is equal to or greater than 15% of their total charges for that fiscal year.
SECTION 2. The Executive Office of Health and Human Services shall adopt all rules and regulations necessary to establish the Large Physician Organizations Assessment and to increase annual appropriations to the Community Hospital Reinvestment Trust Fund, as outlined above, not later than 90 days after the passage of this Act.
