An Act relative to zoning of retail marijuana facilities.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 334 of the Acts of 2016 is hereby amended by striking SECTION 6 in its entirety and inserting in place thereof the following:-
Notwithstanding any general or special law to the contrary, if the cannabis control commission fails to adopt regulations necessary for the implementation of this chapter on or before January 1, 2018, each city or town may refuse to impose or permit zoning ordinances or by-laws for the creation and operation of retail marijuana establishments within the city or town. A retail marijuana establishment shall not possess, cultivate, process, manufacture, package, purchase or otherwise obtain and test marijuana and marijuana products and shall not deliver, sell or otherwise transfer marijuana to any person who is at least 21 years of age until the city or town in which the retail marijuana establishment resides imposes a specific zoning ordinance or by-law.
