An Act relative to local control of marijuana dispensaries.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 334 of the Acts of 2016 is hereby amended in Section 5 subsection 3 (a) (2) by striking clause (i) and inserting in place thereof the following:-

(i) prohibits the operation of one or more types of marijuana establishments within the city or town; except that, notwithstanding any general or special law to the contrary, a city or town that has approved the operation of a medical marijuana treatment center may adopt an ordinance or by-law prohibiting retail marijuana establishments and/or the sale of marijuana to a person not certified as a patient or caregiver in that city or town.
