An Act relative to maintaining the integrity of the judicial system.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1. Chapter 38 of the General Laws is hereby amended by inserting in section 4 after the words "death occurred", the following:-

"; provided that, unnatural deaths involving the discharge of a firearm or use of force by a law enforcement officer shall be investigated by a special prosecutor."

Section 2. Chapter 12 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after Section 26, the following section:

Section 26A.

A special prosecutor appointed as required by Section 4 of Chapter 38 shall be named by the Attorney General.  The legislature shall appropriate sufficient resources for the special prosecutor to carry out the investigation of such unnatural death.

A special prosecutor appointed in accordance with this section shall have no power to convene grand juries.
