(a) All public K-12 schools that are required to serve breakfast under section 1C of chapter 69 of the General Laws where at least sixty percent or more students eligible for free or reduced-price meals under the federal National School Lunch Program shall be required to offer all students a school breakfast after the instructional day has begun and the tardy bell rings.
(b) Each school may determine the breakfast after the bell service model that best suits its students. Service models include, but are not limited to, breakfast in the classroom, grab and go breakfast, and second chance breakfast. Time spent by students consuming breakfast is considered instructional time when students consume breakfast in the students' classroom and instruction is being provided while students are consuming breakfast.
(c) Before [DATE], the State Department of Elementary and Secondary Education shall develop and distribute procedures and guidelines for the implementation of this section, which must be in compliance with federal regulations governing the school breakfast program.
(d)The State Department of Elementary and Secondary Education shall annually collect information about breakfast after the bell at each school and make the information publicly available.
(e) In fulfilling its responsibilities under this section, the State Department of Elementary and Secondary Education shall collaborate with nonprofit organizations knowledgeable about equity, the opportunity gap, hunger and food security issues, and best practices for improving student access to school breakfast. The office shall maintain a list of opportunities for philanthropic support of school breakfast programs and make the list available to schools interested in breakfast after the bell.
